TERMS AND CONDITIONS

Business Acceleration Network, Inc., a Florida-based company ("Business Acceleration Network," "we," or "us"), operates the Business Acceleration Network website www.BusinessAccelerationNetwork.com, which facilitates membership, events, and community engagement. By participating in our programs and accessing or using our Website, you agree to comply with and be bound by the following terms and conditions ("Terms"). If you do not agree to these Terms, please refrain from using our website or participating in our programs.

 


These Terms contain legal rights and obligations; read them carefully.

 

MEMBERSHIP ELIGIBILITY

Membership in the Business Acceleration Network is subject to approval. Prospective members must meet our criteria, as determined by the Business Acceleration Network. Members must be at least 18 years of age unless they are accepted into Tomorrow’s Leaders Today, an entrepreneur youth program for ages 8-26. Or any extenuating circumstances where someone underage may be invited to join.

 

The Business Acceleration Network will consider each application for the following minimum criteria:

  • Prospective Members who operate an active business that demonstrates revenue generation;

OR


The Business Acceleration Network may modify the membership criteria at any time, at its sole discretion, without notification.

If The Business Acceleration Network determines that your company does not fit this description, your membership will be denied and/or terminated.

TERMS AND TERMINATION OF MEMBERSHIP
Membership Duration and Changes: Business Acceleration Network offers quarterly and annual memberships. Occasionally, certain types or durations of memberships may be amended, of which you will be informed in advance prior to applying.

Membership Payment: Members are automatically billed for their membership fees. To discontinue your membership, simply log into your account and cancel it before the next billing cycle. You can also notify us via email (support@businessaccelerationnetwork.com) at least ten business days before your renewal date. Failure to cancel within this timeframe will result in automatic renewal and subsequent charges. Please note that Business Acceleration Network does not provide partial refunds.

The Business Acceleration Network may restrict, suspend, or terminate a Member at any time, with or without prior notice, without liability, and without a refund for an unused or partial term.


AFFILIATE PROGRAM
Members are encouraged to refer new members to the Business Acceleration Network. For every new member referred, members will receive a free month of membership and may receive additional benefits for successful referrals.

INCLUSION AND DIVERSITY

MEMBERSHIP BEST PRACTICES
By fostering positive and mutually beneficial interactions, members contribute to the growth and success of the Business Acceleration Network community.

Support and Collaboration: Members are welcome to support and collaborate with each other on projects, initiatives, and business endeavors within the scope of Business Acceleration Network's mission and values.

Recommendations: Members may provide recommendations and referrals to other members based on their expertise, skills, or services offered, as long as such recommendations are genuine and in good faith.

Business Transactions: Members may engage in business transactions with each other, provided that such transactions comply with applicable laws and regulations and do not involve unauthorized products or services.

Non-defamatory Communication: Members must ensure that all communication with other members is non-defamatory and respectful. Any communication that may harm the reputation or integrity of Business Acceleration Network or its members is strictly prohibited.

MEMBER/STAFF AGREEMENT
In our community, mutual respect and professionalism are paramount. Members and staff alike are expected to engage in all interactions with kindness and professionalism. Any form of harassment or disruptive behavior may lead to termination of membership.


 

  • Communication with Business Acceleration Network Staff/By Our Staff: All communication, whether initiated by members or our staff, should be conducted in a professional manner and in accordance with applicable laws. We value respectful discourse and will not tolerate any communications that are harassing, demeaning, or offensive. The Business Acceleration Network reserves the right to refuse or cancel membership, without refund, in cases where a member's behavior violates this principle.

  • Member Disputes. The Business Acceleration Network is a professional networking and business growth community. Therefore, Members may find the occasion to work together. You are solely responsible for your interactions with other Members. If you are dissatisfied with the work provided by another Member or any interaction with another member in our social media private groups or public pages, membership site, Zoom calls, on private calls, and anywhere else members interact, you are expected to resolve your dissatisfaction with that member directly and in a professional manner. The Business Acceleration Network is committed to fostering harmony and maintaining a peaceful environment for all members. In line with this commitment, we reserve the right to monitor disputes between members. However, it's important to note that while we reserve this right, we are not obligated to intervene or resolve disputes.

  • Unauthorized Communications with Members. All communication with Members must be professional and follow applicable law. Communicating with a Member for the purpose of advertising or solicitation, attempting to convince a Member to buy or sell any unauthorized products or services, and collecting the e-mail addresses of Members for the purpose of sending unsolicited e-mail is prohibited. You may also not transmit any chain letters or junk e-mail to other Members.

  • Adding a Member to your Email List. It is permissible to request Members to explicitly opt-in to your e-mail list. However, if a Member who has previously given written permission to be added to your e-mail list later requests to be removed from your e-mail list, you must do so immediately.

  • Website Password. When you sign up to become a Member, you will choose a password. Keep your password confidential, and do not share it with anyone. Notify The Business Acceleration Network immediately if you suspect any unauthorized use of your account or access to your password.

  • Prohibited Content. The Business Acceleration Network reserves the right to restrict or prohibit the posting of content on its Website. The following content is prohibited on any The Business Acceleration Network Website (including all social media accounts owned and operated by The Business Acceleration Network):

  • Content that promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual;

  • Content that harasses or advocates harassment of another person;

  • Content that exploits people in a sexual or violent manner;

  • Content containing nudity, violence, or offensive subject matter;

  • Content that promotes false or misleading information;

  • Content that promotes an illegal or unauthorized copy of another person’s copyrighted work;

  • Content that involves sales without our prior written consent, such as contests, sweepstakes, bartering, advertising, and pyramid schemes.

  • Content that includes a photograph of another person that a user has posted without that person’s consent.

  • Criminal Activities. The following activities are illegal or prohibited on the Website. If a user engages in any of these activities, the Business Acceleration Network will terminate their membership immediately:

  • Criminal or tortious activity, including child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets;

  • Posting content that furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities; or

  • Using any information obtained from their Membership in order to harass, abuse, or harm another person.


PROHIBITED CONTENT AND ACTIVITIES
Members must not post prohibited content on the Website, engage in criminal activities, or misuse member data. Business Acceleration Network reserves the right to remove any content that violates these terms.

PHOTOGRAPHY CONSENT AND RELEASE
By attending Business Acceleration Network events, you consent to the use of your likeness in promotional materials. The Business Acceleration Network owns the rights to event photos and videos. By attendance at a Business Acceleration Network event, you acknowledge the following:

  • The Business Acceleration Network may copyright, reproduce, publish, distribute, and use photos and videos of me for any purpose connected to the activities of The Business Acceleration Network.

  • I waive any right to inspect or approve any finished works that contain my image or likeness.

  • I acknowledge that The Business Acceleration Network is the owner and copyright proprietor of all rights, title, and interest in and to all these works, and I assign to The Business Acceleration Network any right, title, or interest that I may have or be deemed to have to them.

  • I waive, release, and discharge The Business Acceleration Network from any claim I may have for libel, defamation, invasion of privacy, or any violation of any right to publicity or any other right that I may have arising out of the publication or use of such works.


Members retain ownership of content they post on the Website but grant Business Acceleration Network a license to use and display such content. Members are responsible for ensuring they have the necessary rights to post content.

HYPERLINKS; THIRD-PARTY WEBSITES
Business Acceleration Network is not responsible for the content of third-party websites linked from our Website. Members access such sites at their own risk.

 

PROPRIETARY RIGHTS

  • Content that you post on the Website maintained by the Business Acceleration Network remains your content. You do, however, grant the Business Acceleration Network a limited license to use and display that content on the Website. By posting content on the Website, you represent that you own or have received a license to post such content. You also agree to defend and indemnify the Business Acceleration Network for any content that you post or share to the Website that is subject to any third-party claim, including but not limited to infringement, defamation, or violation of applicable law. The Business Acceleration Network, in its sole discretion, can refuse to post or remove any content posted by you if you violate these Terms or if the content posted by you is offensive, illegal, or violates the rights, harms, or threatens the safety of any person.

  • The Business Acceleration Network does not endorse content posted or communicated by Members and assumes no responsibility for monitoring Members’ use of the Website.

  • Content that is posted by the Business Acceleration Network on the Website is owned by the Business Acceleration Network. The Business Acceleration Network owns and retains all rights in its content.


WARRANTY DISCLAIMER; LIMITATIONS ON LIABILITY

Business Acceleration Network makes no warranties regarding the accuracy or reliability of content on the Website. We are not liable for any loss or damages arising from your use of our Website or attendance at our events.


DISPUTE RESOLUTION AND GOVERNING LAW

Conflicts and disagreements are a natural part of any relationship. At the Business Acceleration Network, we value open communication and strive to resolve issues constructively. Therefore, any disputes arising from these Terms or membership in the Business Acceleration Network shall be addressed through our conflict resolution process outlined below. If we don’t resolve the dispute, we defer to the mediation process aimed at finding mutual agreement and understanding in the state of Florida. These Terms are governed by the laws of Florida.

We both commit to maintaining an "attitude of resolution" and agree to engage in a collaborative resolution process when necessary. Our goal is to preserve the integrity of our community and foster positive relationships among members.

 
 

Our Conflict Resolution Process:

  1. Open Communication: We start by engaging in open and honest dialogue, focusing on our shared vision and intentions rather than dwelling on the problem. Both parties agree to communicate respectfully and promptly, aiming to schedule a discussion within five business days of acknowledging the issue.

  2. The Work of Byron Katie: We embrace the principles of "The Work" by Byron Katie, which encourages self-inquiry and questioning of our beliefs.   3. Neutral Facilitation: If necessary, we may seek the assistance of a neutral third party to facilitate our dialogue and help us reach a resolution. This neutral party acts as a mediator, guiding us through constructive communication and problem-solving.

Engagement of Stewart Levine, Esq. as a Mediator: In cases where resolution remains elusive, we may choose to engage the services of Stewart Levine, an experienced mediator known for his expertise in conflict resolution. CHANGES TO THESE TERMS
